Youngest Daughter of Janet Lim-Napoles, Jeane, is charged with tax evasion

The charges facing the Napoles family isn't over yet. After Janet Lim-Napoles alledged involvement to the 10 billion scam, here comes her youngest daughter Jeane facing  tax evasion filed by Bureau of Internal Revenue (BIR).

The total income tax liability of the youngest Napoles from 2011- 2012 according to BIR Commissioner Kim Henares was P32.06 million.

Jeane Napoles, a registered tax payer of the country, hasn't filed any income tax return since 2008 from her acquired real estate properties in the US and the Philippines, Henares said.

“Wala siyang dineklara, wala siyang finile na return. So meron siyang income na undeclared. That’s why may tax evasion. Hindi ka naman pwedeng magkaron ng peran na wala ka namang kinikita. Either may nagbigay sa yo, so dapat may donor’s tax. May minana ka dapat may estate tax. Kung wala kaming record na may dinonate sa yo, wala kaming record na may minana ka, edi most probably kinita mo yan na hindi mo dineklara," Henares said. 

(She didn't declare and didn't file any returns, so she has undeclared income. That's why there's tax evasion. You can't have money if you don't have a source of income. Either someone gave you, so there should be donor's tax. If you inherited something, there should be estate tax. If we don't have a record of a donation for you, we won't have a record of your inheritance, so most probably you earned it but didn't declare, Henares said)

Based on the investigation, the youngest Napoles acquired a condominium unit at the posh Ritz Carlton in Los Angeles, California worth P54.73 million in 2011 and a share of a farm lot in Bayambang, Pangasinan acquired in 2012 worth P1.49 million

"BIR records, however, showed that Napoles did not file any income tax return (ITR) for taxable years 2011 and 2012; nor were there any records of returns filed that will prove that gifts, bequests or devices were given to her," the BIR said in a statement.

If a taxpayer's expenditures for a year exceed his or her reported income and the source of the funds used for the expenditure is unexplained, "such expenditures represent unreported income," the agency said.
